Federal Lawyer Michael Leonard appeared on WGN Radio 720 John Williams’ show on Friday March 31, 2023 to discuss the Trump Indictment. Mike explained to John and his listeners the apparent basis for the yet to be unsealed State Court (New York) criminal Indictment against former President Trump. It has been reported that the Grand Jury in Manhattan has returned a 30-Count Indictment against him. It appears that the basis for the charges relate to purported violations of a New York statute regarding the falsification of corporate business records. That New York statute only classifies violations as misdemeanors. However, that statute enhances violations to felonies in the event that the underlying violation of the statute is intended to aid in, or conceal, the violation of another law. Thus, it appears that former President Trump will be charged with felonies based upon the theory that the payment made to Stormy Daniels, purportedly on his behalf, as well as possibly payments he or the Trump organization made to his former attorney, Michael Cohen, violated campaign finance laws. Mike talked with John Williams about the Grand Jury process underlying the Indictment; possible defenses to the charges; possible challenges facing the prosecution team; and issues regarding the chief cooperating witness, Mr. Cohen.
