Chicago Criminal Defense Lawyer Explains Important Amended to Illinois Juvenile Justice Act. The Illinois Juvenile Court Act of 1987 (“Act”) will undergo an important Amendment, which will begin to take effect in 2025.
Many individuals struggle with attempting to expunge their juvenile criminal records – sometimes years or decades after the fact. The Amendment provides that, on the date that the juvenile offender is adjudicated delinquent, the juvenile court Judge shall (i.e., is required to) schedule a future date to enter the automatic Expungement Order. The Act further provides that the juvenile must be notified, but is not required to be present for the scheduled court date when automatic expungement is to be Ordered.
