Chicago’s Leading Criminal Defense Lawyer Micheal Leonard on what we can expect to see in the Luigi Mangione case. The recent tragic shooting of the CEO of United HealthCare, Brian Thompson, resulted in the relatively quick arrest of Luigi Mangione. From what has been shared and reported publicly, Mr. Mangione comes from a well-to-do Baltimore area family, and experienced quite a bit of success in high school and college. However, those reports also contain information suggesting that perhaps Mr. Mangione has recently suffered from mental health issues, and tremendous physical pain arising out of a back injury. Many have been speculating about what the future course and conduct of this case. Here are some thoughts:

If the evidence in fact conclusively places Mr. Mangione at the crime scene; ties him to the exact gun used in the shooting; and otherwise connects him to the shooting, there is of course a substantial possibility that Mr. Mangione’s counsel may engage in serious plea negotiations with New York State prosecutors. Of course, Mr. Mangione’s counsel will likely be able to present a robust mitigation package on behalf of Mr. Mangione, particularly if the reports of his emotional and physical health are accurate. That said, prosecutors may be hesitant to offer what might be perceived as a sweet-heart plea deal in light of the publicness and brazenness of the commission of the crime on the street in Manhattan during the daylight hours. On the other hand, the Mangione case immediately ushered in a backlash against the health care industry which appeared to attempt to explain away, and almost champion, the crime and the shooter. Thus, prosecutors must be mindful of the potential jury reaction to the case, and thus the possibility for a mistrial or outright acquittal.

What we can expect with certainty is for the defense team to have Mr. Mangione examined by top-flight experts with regard to his psychiatric and psychological state in the months and weeks leading up to the shooting, at the time of the shooting, and presently. This is not only for the purpose of potential mitigation, but also to explore the possibility of relying upon a mental defect or insanity theory at trial.

Stay tuned. This case is likely to take a number of additional twists and turns before it becomes clear if it will proceed to trial, or be resolved by way of a plea agreement.
