Chicago’s Best Federal Criminal Defense Lawyers obtain complete dismissal of “felon in possession” case based upon Bruen. In United States v. Eatman, Leonard Trial Lawyers represented a defendant who was charged under Federal law with violating 18 U.S.C., Section 922(g) – otherwise known as the “felon in possession of a firearm” statute. The case was brought against Leonard Trial Lawyers’ client by the United States Attorneys’ Office for the Northern District (Chicago). Matthew Chivari and Michael Leonard, on behalf of the defendant, filed a Motion to Dismiss the Indictment, arguing that – consistent with the United States Supreme Court’s holding in Bruen (which has been discussed in prior blog posts on this website), the statute was unconstitutional. In granting that Motion to Dismiss, Judge Robert Gettleman agreed in a lengthy written Opinion. As a result, Leonard Trial Lawyers’ client will not face that federal charge at all.
